Notification of terrestrial satellite station exempted from the granting of right to use a radio frequency

If a terrestrial satellite station is exempted from the obligation of obtaining a radio spectrum right of use according to EETT Decision No. 721/2/12-06-2014 “Regulation on the terms of use of individual radio frequencies or radio frequency bands” (Official Gazette 1713/B/26-06-2014), as in force, a relevant notification must be submitted to EETT prior to station’s operation.

Having regard to Ministerial Decision No. 27217/505/4-6-2013 “Antenna Construction Facilities of Low Electromagnetic Environmental Impact exempted from licensing in accordance with paragraph 23 of Article 30 of Law 4070/2012” (Official Gazette 1442/Β/14-6-2013), the aforementioned declaration shall be submitted depending on the category of antenna construction. Two categories of stations are identified:

A. Where the antenna construction of the station shall meet all requirements defined in the Joint Ministerial Decision No. 27217/505/4-6-2013 “Antenna Construction Facilities of Low Electromagnetic Environmental Impact exempted from licensing in accordance with paragraph 23 of Article 30 of Law 4070/2012” (Official Gazette 1442/Β/14-6-2013) for category “H” ACFLI (especially, but not limited to: The input power of the antenna is less or equal to 2 Watts and the antenna diameter is less or equal to 1.8 meters), the granting of an antenna construction license shall not be required, but submitting to ΕΕΤΤ a standardized Declaration of Category “H” ACFLI installation at least ten (10) days prior to the installation of the antenna construction and publishing the Declaration on the provider’s website shall be required (available in Greek):

Β. Where a terrestrial satellite station exempted from the granting of a right to use a radio frequency in accordance with EETT Decision No. 721/2/12-06-2014 “Regulation on terms of use for individual radio frequencies or radio frequency bands” (Official Gazette 1713/B/26-06-2014), as in force, and the input power of the antenna is higher than 2 Watts and/or the antenna diameter is 1.8 meters and/or all other conditions of the Ministerial Decision No. 27217/505/13 (Official Gazette 1442/Β/14-6-2013) are not met, the following Declaration shall be submitted to EETT (available in Greek):

It is pointed out the above-mentioned Declaration does not exempt the owner of the station from the obligation to acquire an antenna construction license, as provided for in Law 4070/2012 and Law 2801/2012.
